Terms and Conditions

Welcome to Bebecare. These Terms and Conditions (“Terms”) govern your access to and use of the Bebecare mobile application and services (“Platform”). By using Bebecare, you agree to be bound by these Terms.

1. NATURE OF THE PLATFORM

Bebecare operates solely as a digital platform that connects parents (“Clients”) with independent childcare providers (“Nannies”).

Bebecare:

  • Does NOT employ, manage, or supervise Nannies
  • Does NOT act as an agency or contractor
  • Does NOT guarantee service outcomes

All Nannies are independent service providers.

2. USER ELIGIBILITY

By using the Platform, you confirm that:

  • You are at least 18 years old
  • You have the legal capacity to enter into agreements
  • All information you provide is accurate and truthful

3. REGISTRATION REQUIREMENTS

3.1 For Parents (Clients)

Parents are required to provide accurate household information, including:

  • Family composition
  • Medical background of household members
  • Known allergies or health risks
  • Special instructions relevant to childcare

By submitting this information, you:

  • Consent to share relevant details with your selected nanny
  • Acknowledge that this information is necessary for safe childcare
  • Agree that you are responsible for the accuracy of the information provided

3.2 For Nannies

Nannies are required to submit:

  • Valid government-issued ID
  • NBI Clearance
  • Police Clearance

By submitting these documents, Nannies:

  • Consent to background verification
  • Agree to periodic re-verification if required
  • Acknowledge that incomplete or falsified documents may result in suspension or termination

Bebecare does not guarantee the authenticity or completeness of submitted documents.

4. PRIVACY AND DATA PROTECTION

Bebecare respects user privacy and complies with the Data Privacy Act of 2012.

  • Sensitive information (including medical data) is collected solely for childcare safety purposes
  • Household information is only shared with the selected nanny after booking confirmation
  • Information is not publicly visible
  • Users have the right to access, correct, or request deletion of their data

Bebecare implements reasonable security measures but does not guarantee absolute protection.

5. BOOKINGS AND SERVICES

  • All bookings are arranged through the Platform
  • Service terms (schedule, duties, compensation) must be agreed upon by both parties
  • Bebecare may charge service or platform fees

6. PAYMENTS, CANCELLATIONS, AND REFUNDS

  • Payment terms will be defined within the Platform
  • Cancellation policies (including fees or penalties) shall apply as indicated at the time of booking
  • No-shows or late cancellations may result in charges or account penalties

7. OUTSIDE TRANSACTIONS

Bebecare strongly discourages transactions outside the Platform.

  • Bebecare is NOT responsible for any agreements, payments, or incidents occurring outside the Platform
  • Users who transact outside the Platform assume full risk
  • Platform protections, including verification and dispute support, may not apply

8. USER CONDUCT

All users agree NOT to:

  • Engage in abuse, harassment, or exploitation
  • Provide false or misleading information
  • Participate in illegal activities
  • Endanger children or household members

Violation may result in account suspension or termination.

9. EMERGENCY AND INCIDENT PROTOCOL

In case of emergency:

  • Nannies must prioritize the safety of the child
  • Nannies must immediately contact the parent/guardian
  • If necessary, contact emergency services

Parents must provide emergency contact details and relevant medical information. These protocols align with childcare safety principles under the Child and Youth Welfare Code.

10. RATINGS AND REVIEWS

  • Users may rate and review each other after services
  • Reviews must be honest and not abusive
  • Bebecare reserves the right to remove inappropriate content

11. INDEPENDENT CONTRACTOR RELATIONSHIP

Nannies are independent contractors and are:

  • Not employees of Bebecare
  • Responsible for their own taxes, obligations, and conduct

Nothing in this Agreement creates an employer-employee relationship under the Philippine Labor Code.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Bebecare shall not be liable for:

  • Injuries, accidents, or damages
  • Theft or misconduct
  • Negligence or disputes between users
  • Losses arising from service arrangements

13. INSURANCE DISCLAIMER

Bebecare does not provide insurance coverage for:

  • Childcare services
  • Personal injury
  • Property damage

Users are encouraged to secure their own insurance if necessary.

14. ACCOUNT SUSPENSION AND TERMINATION

Bebecare reserves the right to:

  • Suspend or terminate accounts
  • Remove users from the Platform
  • Deny access without prior notice in serious cases

15. DISPUTE RESOLUTION

  • Users are encouraged to resolve disputes amicably
  • Bebecare may assist but is not obligated to mediate
  • Any legal disputes shall be governed by Philippine laws
  • Venue shall be in the appropriate courts within the Philippines

16. AMENDMENTS

Bebecare reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
